Charlotte, NC (October 2, 2024) – Attorneys representing local residents today filed a lawsuit against Duke Energy, accusing the company of negligence in handling coal ash contamination in Mooresville, NC. During a press conference held at the Mecklenburg County Courthouse, the legal team, along with plaintiff Tanya Hall, highlighted the devastating health impacts linked to the use of coal ash as fill beneath homes and businesses.
The lawsuit claims that hazardous materials, including arsenic and heavy metals, from Duke Energy’s coal ash operations were improperly used during the rapid development of Mooresville in the 1990s and 2000s. This contamination, according to the lawsuit, has led to a spike in thyroid cancer rates and other serious health concerns within the community.
Lead attorney Carlos E. Moore of the Carlos Moore Law Group addressed the media, stating: “Duke Energy’s irresponsible coal ash practices have endangered the lives of Mooresville residents. This lawsuit is about holding them accountable for the harm caused and demanding justice for the families who have suffered far too long. The company must be brought to task for prioritizing profit over the health and safety of this community.”

The lawsuit seeks compensation for those affected and calls for a full investigation into the extent of the contamination. The plaintiff and her legal team, which also includes Desmon L. Moore of The Moore Law Group, and Sean Pittman of The Pittman Law Group, P.L., are urging federal agencies, including the Environmental Protection Agency (EPA), to intervene and implement comprehensive cleanup efforts to ensure that residents have safe living conditions. They are committed to seeking justice for Mooresville and the surrounding community and restoring the public’s faith in environmental and public health safeguards.
